ANJANA MISHRA ORAL ORDER 21-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Salkhua P.S. Case No.69 of 2015, Special Case No.2/2015, for allegedly having committed the offence under Section 7 of the E.C. Act and Section 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the son of the PDS dealer Premlal Yadav, but the rice recovered from the tractor was not for selling the same in the black-market as has been alleged. He further submits that the petitioner has no connection with the aforementioned carriage of the rice from one place to another. He further submits that the tractor owner has also been extended the

Patna High Court Cr.Misc. No.47057 of 2015 (3) dt.21-01-2016 2/2 privilege of anticipatory bail in Cr.Misc. No.32863 of 2015, vide order dated 11.8.2015.

Considering the aforementioned facts and circumstances and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saharsa, in connection with Salkhua P.S. Case No.69 of 2015, Special Case No.2/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
