Case No. 362 of 2016 registered under Sections-399, 402, 414 of the Indian Penal Code and 25(1-b)a, 26(ii), 35 Arms Act and Sections-8, 20 (b)(ii)(B) of the NDPS Act, in which petitioners seek bail and accordingly, these petitions are being heard and disposed off by this common order.
Heard learned counsel for the petitioners and the State. It is alleged in the written report that on confidential information that some criminals are proceeding from Hajipur for committing crime in between Muzaffarpur to Hajipur on N.H. 77, the informant alongwith other police party started checking the vehicle. During course of checking, one Scorpio vehicle was apprehended on which the petitioners alongwith seven other persons were sitting. The police recovered arms ammunition from possession of the petitioners and other persons as mentioned in the written report and 5 kgs Ganja from beneath the rear seat of Scorpio.
It has been submitted that other accused have been granted bail by coordinate bench of this court. The C.D. has been received.
The learned APP has submitted that petitioners have been found in possession of country-made pistol and live cartridges as well as cash etc. and also 5 kg. Ganja was recovered from beneath the rear seat of Scorpio. The witnesses in the case diary have supported the allegation against the petitioner. In such circumstances, this court is not inclined to grant bail to the petitioners at this stage. The prayer is accordingly rejected.
Petitioners are given liberty to renew their prayer for bail after six months in the court below itself if no substantial progress is made in the case. The court below in that event shall give reason in the bail order for not concluding the trial within aforesaid period.
