Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kanti P.S. Case No. 781 of 2019 lodged under Sections 304(B)/34 of the Indian Penal Code.

As per prosecution case, the allegation of caused death to the informant's niece is there in the F.I.R. which is alleged to be caused by the petitioner and his family members. All were made accused in this case.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the entire F.I.R. has been lodged on the basis of hear say witness. He further submits that petitioner is the mother-in-law aged about 71 years. He further submits that there is general and omnibus allegation against the petitioner.

He further submits that the antecedent of the petitioner is clean and she is in custody since 01.03.2021. He further submits that the other co-accused persons other than husband have already been granted bail by the Co-ordinate Bench of this Court vide order dated 09.05.2022 passed in Cr. Misc. No. 58646 of 2021.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XI, Muzaffarpur in connection with Kanti P.S. Case No. 781 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
