The petitioner apprehends his arrest in Supaul P.S. Case No.633 of 2018 registered under Sections 420, 467, 468, 471, 120B, 196, 197, 198, 199 and 201 of the Indian Penal Code.
The gist of allegation is that the petitioner being mukhiya appointed many persons on forged and fabricated educational certificates.
Learned counsel for the petitioner submits that there was a committee constituted by the Block Education Officer for verifying the genuineness of the certificates of the candidates. It is submitted that the candidate, who is alleged to have produced fake and forged certificates has already been granted
Patna High Court CR. MISC. No.41538 of 2019(2) dt.05-07-2019 2/2 anticipatory bail by a coordinate bench of this court in Cr.Misc.No.16444 of 2019 on 15.03.2019. The case of the petitioner stands on better footing.
Learned counsel for the State, however, opposed the prayer for anticipatory bail of the petitioner. Having considered the facts aforesaid and nature of allegation made against the petitioner and the fact that similarly situated accused person has been granted anticipatory bail by a coordinate bench of this court, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S. Case No.633 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
