Petitioner is languishing in custody since 20.04.2017 in connection with Rasulpur P.S. Case No. 66/2016 for offences punishable under Sections 302, 201/34 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that his daughter Kusum Devi, who was married to the petitioner in the year 2009, has been killed by the petitioner (her husband) and mother-in-law and dead body was burnt.
It has been submitted by the learned counsel for the petitioner that the informant has lodged the present case without knowing the real facts and is a pairvikar of the petitioner in the present application. He submits that the matter has been
Patna High Court Cr.Misc. No.26058 of 2017 (3) dt.27-07-2017 2/2 compromised and a compromise petition has been filed before the learned court below and that the informant is ready to become the bailor of the petitioner. It is further submitted that the wife of the petitioner died a natural death.
However, learned APP for the State opposes the prayer for bail.
Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-X, Chapra in connection with Rasulpur P.S. Case No. 66/2016. (Nilu Agrawal, J) Rajesh/- U T
