The petitioner has renewed his prayer for bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 4.4.2022 (Annexure-1) passed in Cr. Misc. no. 54131 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 5.8.2021.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.42663 of 2022(2) dt.14-09-2022 2/2 taking into consideration the nature of allegation against the petitioner, the liberty granted to the petitioner in the earlier order of rejection dated 4.4.2022 and the petitioner having remained in custody for more than 1 year since 5.8.2021, the petitioner is directed to be enlarged on bail in connection with Saraiya P.S. Case no. 553 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
