JUSTICE RAKESH KUMAR ORAL ORDER 26-07-2016 Heard Sri Sangeet Deokuliar, learned counsel for the petitioner and Sri Nand Kumar, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Piprahi P.S. Case No. 31 of 2016 registered for the offence under section 47A of the Excise (Amd.) Act 2016, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that nothing was recovered from conscious possession of the petitioner whereas from abandoned toilet some wine was recovered and on that accusation petitioner has been made accused.
Patna High Court Cr.Misc. No.28145 of 2016 (2) dt.26-07-2016 2/2 Keeping in view the nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Jagannath Mahto @ Bhathu Mahto @ Bharathu Mahto be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Sheohar / concerned court in connection with Piprahi P.S. Case No. 31 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
