Petitioner apprehends his arrest in Nath Nagar P.S. Case No.159 of 1997 instituted for the offence under Section(s) 364/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, X, Bhagalpur.

Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 03.04.2018 passed in Cr. Misc. No.3242 of 2018. It is mentioned in the said order that process under Sections 82-83 Cr. P.C. was issued against the petitioner. Charge-sheet has also been submitted against the petitioner showing him absconder. In such circumstances, this Court does not find any fresh ground to entertain this second anticipatory bail application.

Patna High Court Cr.Misc. No.46676 of 2018 (3) dt.08-08-2018 2/2 Prayer of the petitioner for grant of anticipatory bail is, again, rejected.

Petitioner may surrender before the Court below and make prayer for regular bail, which will be considered and disposed off by the Court below in accordance with law without being prejudiced by this order.
