Criminal Miscellaneous No.30191 of 2017 Arising Out of PS.Case No. -155 Year- 2015 Thana -BARACHATTI District- GAYA ====================================================== Sunil Kumar Singh, S/o Rajdeo Singh, resident of Village- Kamrua, Ward No.-1, P.S.- Town Aurangabad, District- Aurangabad. .... .... Petitioner
Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Parmod Kumar, Advocate For the Opposite Party : Mr. Shyameshwar Dayal (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to release on provisional bail for 30 days on the ground of illness of his father as earlier his prayer for bail on merit has already been rejected twice. It is submitted that the father of the petitioner is suffering from heart disease and, as such, the petitioner should be released so that he may be able to get his father treated. The father of the petitioner is aged about 70 years and the petitioner is only son of his father and there is no male member in his family to look after his father. The copies of report of medical treatment have been annexed as Annexure-3. The learned A.P.P. opposes the prayer by submitting that the petitioner's father is being treated which is evident from
Patna High Court Cr.Misc. No.30191 of 2017 (3) dt.02-08-2017 2/2 Annexure-3 itself.
In the facts and circumstances stated above, I am not inclined to grant provisional bail to the petitioner and accordingly, his such prayer stands rejected.
