JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-04-2021 Heard Mr. Sanjay Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner seeks modification of the order dated 01.07.2020, passed in Cr. Misc. No. 81784 of 2019, whereby the time for surrender before the court below was extended to a further period of six weeks from the date of passing of the order.

The petitioner could not surrender within the aforesaid stipulated period.

For the reasons stated in the application, the

Patna High Court CR. MISC. No.8964 of 2021(2) dt.07-04-2021 2/2 prayer made on behalf of the petitioner for modification of the order, referred to above, is allowed.

In case the petitioner surrenders before the court below within a period of eight weeks from today, he shall be accorded the privilege under the order dated 19.07.2019 but all the terms and conditions which have been imposed in the aforesaid order shall subsist. The order dated 01.07.2019 stands modified to the extent indicated above.

The modification application stands allowed.
