This is an application for bail in connection with Ekchari P.S. Case No. 7 of 2017 registered for the offences punishable under Sections 364, 302, 201 and 34 of the Indian Penal Code. Allegation against the petitioner and other co-accused persons is of kidnapping and thereafter killing the deceased. Submission of learned counsel for the petitioner is that petitioner is brother-in-law of son of the victim and even the dead body was not recovered and no specific allegation is attributed against the petitioner. Further submission is that co-accused persons having similar allegation have been granted bail in Cr.Misc.No. 27588 of 2017, vide order dated 1.8.2017 by a coordinate Bench of this Court and petitioner is in custody since 11.5.2017.

Having heard both sides and in view of facts and

No.42380 of 2017 (2) dt.12-09-2017 2/2 circumstances and also in view of fact that co-accused persons have been granted bail, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Bhagalpur, in connection with Ekchari P.S. Case No. 7 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
