Petitioner prays for bail in connection with Bochahan P.S.Case No. 165 of 2018 registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Sections 30(a), 32(ii) and 38(ii) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 244.4 litres of liquor from the van of which the petitioner is said to be the driver. Submission of learned counsel for the petitioner is that he is driver and he has nothing to do with the seized articles and he is in custody since 23.7.2018, having no criminal antecedent. Further submission is that co-accused has been granted bail by a coordinate Bench of this Court vide order dated 7.9.2018 passed in

Patna High Court Cr.Misc. No.51418 of 2018 (3) dt.04-10-2018 2/2 Cr.Misc.No. 55751 of 2018 and charge sheet has been submitted in this case.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Bochahan P.S.Case No. 165 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
