JUSTICE RAVI RANJAN ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The Petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 323, 341, 504, 506/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that all other accused persons have already been granted anticipatory bail in view of the fact that there is no specific allegation upon them. It is contended that the petitioner has allegedly assaulted by lathi and rod upon the back and leg of the informant, however, the injury report shows that the injuries are simple in nature. It is also urged that the petitioner is having clean antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the
Patna High Court Cr.Misc. No.34153 of 2016 (2) dt.06-09-2016 2/2 event of arrest/surrender before the court below within a period of six weeks from today in Dumra P.S. Case No.137 of 2015, G.r. No.1888 of 2015 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sitamarhi, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure. However, at the time of accepting bail bond, the court below will verify and assure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bond would be accepted otherwise he would be taken into custody.
