JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-11-2018 The petitioner seeks regular bail in connection with Mahkar P.S. Case No. 174 of 2017, registered for offences punishable under Sections 341, 323, 325, 307 and 504 of the Indian Penal Code and later on added Section 302 of the Indian Penal Code.

Allegation is that petitioner and three other accused persons assaulted the father of the informant by means of lathi due to which he sustained injury and later on succumbed to his injury.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he has been in judicial custody since 23.04.2018. Heard learned A.P.P. also.

No.52208 of 2018(3) dt.02-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Mahkar P.S. Case No. 174 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
