JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-04-2022 Heard Mr. Ram Hriday Prasad, learned counsel for the petitioner and Mr. Atul Chandra, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Nalanda District Excise Case No. 112 C3 Ex/2021 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act 2018.

Prosecution report, in a nutshell, is that Excise Officials, on the basis of secret information proceeded towards the place of occurrence and recovered 766.440 litres of illicit liquor from a vehicle parked in front of a hotel. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely been implicated in this case mainly because the petitioner has been

No.51639 of 2021(2) dt.22-04-2022 2/2 running a motel/eatery on the highway and the driver of the vehicle parked the vehicle in front of the motel/eatery of the petitioner for having some food etc. He further submits that petitioner is in custody since 08.05.2021 and the charge-sheet has been submitted in the matter.

Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is not the owner or the driver of the said vehicle wherefrom the recovery of illicit liquor has been made and petitioner having no criminal antecedent is in custody since 08.05.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, RANJAN KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar, learned Additional Sessions Judge-II-cum-Special Judge, (Excise), Biharsharif, Nalanda in connection with Nalanda District Excise Case No. 112 C3 Ex/2021.
