The petitioner seeks bail in Masaurhi P. S. Case No. 96 of 2019 instituted for the offence under Section(s) 395 of the Indian Penal Code.

Learned counsel for petitioner submits that there is no recovery of any incriminating article from possession of this petitioner. No T.I.P. has been held.

In the written report, it is alleged that one truck loaded with coriander, back peeper, Chhuhara etc. was going to Gaya for delivery and in the way said truck was looted by some unknown miscreants. The miscreants were calling one another by taking name as Sahendra, Ram Pukar, Pramod and Rakesh. Learned counsel for petitioner has submitted that

Patna High Court CR. MISC. No.40794 of 2019(2) dt.08-07-2019 2/2 name of this petitioner has been mentioned in the FIR without his parentage. No TIP has been held till date. Petitioner has been remanded in this case on 5.4.2019 and since then he is in custody.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Masaurhi, in connection with Masaurhi P. S. Case No. 96 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
