2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. 331.5 liters of Nepali country-made liquor has been recovered from a Bolero vehicle.

4. It is submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the vehicle in question.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got five criminal antecedent of offence punishable under Sections 392, 395 & other sections of I.P.C.

6. Considering the fact that petitioner has got five
