The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 328/406/498A of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

Petitioner is husband of Opposite Party No.2. Allegation is of demand of dowry and torture for the same. The matter was sent for mediation which failed.

Submission of learned counsel for the petitioner is that petitioner is still ready for restitution of conjugal life.

No.51302 of 2018(5) dt.24-01-2020 2/2 Learned counsel for Opposite Party No.2 submits that in view of the torture committed by the petitioner it is difficult for Opposite Party No.2 to live with the petitioner. Considering the chances of settlement in future, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Complaint Case No. C-195 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. The petitioner shall not leave the country without permission of the trial Court.
