The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364 and 302/34 of the IPC and Section 27 of the Arms Act.
The prosecution case as per the Fardbeyan of Sita Devi recorded on 24.8.1995 by Md. Iftekhar Ahmad Ansari, Incharge , Chiutaha O.P. is to the effect that the husband of the informant was sleeping in the Verandah but in the following morning he was found missing. On search, the informant found that the dead body of her husband was lying at some distance which led to registration of FIR against unknown. During investigation, name of the accused persons including the petitioner surfaced.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.55919 of 2018(6) dt.25-01-2019 2/2 the charge sheet was submitted in 2015 declaring the petitioner absconder.
In the circumstances, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Semra P.S. Case No. 21 of 1995 pending in the Court of the learned J.M. Ist Class, Bagaha, West Champaran. However, let the learned court below consider the prayer of the petitioner for regular bail, keeping in view the fact that the case was registered in 1995 against unknown and during investigation name of the petitioner sprang up, in case the petitioner surrenders within six weeks in connection with the aforementioned case.
With the aforesaid observation/direction, this application is disposed of.
