The petitioner seeks bail in anticipation of his arrest in connection with Bairiya P.S. Case No. 175 of 2008 dated 02.12.2008 instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code. The husband and son of the informant were shot dead. When the informant went to the place of occurrence on hearing the sound of gun shot, she spotted Sanjay Yadav, Nagendra Yadav and others fleeing away from the place of occurrence.
Learned counsel for the petitioner has submitted that he has not been named in the F.I.R. and his name has transpired during the course of investigation.
Patna High Court Cr.Misc. No.52920 of 2018(3) dt.30-10-2018 2/2 Some of the similarly situated co-accused persons have reportedly been granted anticipatory bail by a Bench of this Court.
Regard being had to the aforesaid fact as also taking into account the clean antecedent of the petitioner, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, West Champaran at Bettiah in connection with Bairiya P.S. Case No. 175 of 2008, subject to the conditions as laid down under Section 438
(2) Cr.P.C.
