JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-12-2021 The petitioners seek bail in anticipation of their arrest in connection with Gopalpur (Rangra) P.S. Case No. 408 of 2019, dated 10.12.2019, instituted for the offences under Sections 186, 332, 379, 353 and 120-B of the Indian Penal Code.

The accusation against the petitioners is of having driven away their vehicles to avoid its checking at the barrier

Patna High Court CR. MISC. No.39279 of 2020(2) dt.07-12-2021 2/3 by the police officers. The vehicles were driven in such a speed that the informant feared that they along with their associates might have been trampled down.

It appears from the bail application that the petitioners are the owners of two vehicles in question and are owners of other vehicles as well. There is no allegation in the F.I.R. of the vehicles belonging to the petitioners being used for any illegal purpose attracting the attention of the police officers. The accusation against the petitioners is based only on supposition.

Regard being had to the facts afore-stated and taking into account that they have no criminal antecedents, they, in the event of their arrest or surrender before the learned Court below within a period of three weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Naugachhia, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No. 408 of 2019, subject to the conditions laid
