JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner and learned Additional P.P. for the State.

The petitioner is apprehending his arrest in a case registered under Sections 272, 273 of the IPC and 47, 51 and 52 of the Excise Act.

The prosecution case is that form the house of the petitioner eight litres of country made liquor was recovered. Learned counsel for the petitioner submits that recovery was made from the joint possession of his family members and the petitioner is youngest member of the family, who used to live in Punjab for his livelihood. It is also submitted that the petitioner is innocent having no criminal antecedent as stated in paragraph-3 of

Patna High Court Cr.Misc. No.28186 of 2016 (2) dt.13-07-2016 the petition.

In the facts and circumstances of the case, let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned court below within a period of six weeks from today in connection with Rajepur P.S.Case No. 41 of 2016, G.R.No. 1860/16, pending in the court of the learned Chief Judicial Magistrate, East Champaran, Motihari. With the aforesaid observation, this application is disposed of.
