Petitioner, who is in custody, seeks bail in connection with Pawana P.S. Case No. 41 of 2016 registered for the offences punishable under Sections 147, 148, 149, 342 and 302 of the Indian Penal Code and under Section 27 of the Arms Act.

Informant who is the father of the deceased has alleged that when his son was returning back to his village on his motorcycle then on the way this petitioner stopped him and dragged him inside the house and thereafter all accused persons badly assaulted him as a result of which he died. It has been submitted on behalf of the petitioner that he has been falsely implicated in this case because of

Patna High Court Cr.Misc. No.51988 of 2018(4) dt.11-10-2018 2/2 political enmity. There is no specific allegation against petitioner. He has no criminal antecedent. He is in custody since 15.02.2018.

In the facts and circumstances of the present case the petitioner be enlarged on bail by the court below after framing of charge on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur, Ara in connection with Pawana P.S. Case No. 41 of 2016.
