This is a case registered under sections 379, 411 and 34 of Indian Penal Code and section 33 of the Forest Act, 1927. Allegation against the petitioner is that while they were cutting some Peepal tree from Government land and loading it on a tractor the informant, a police officer, went there to stop. On seeing police force, they fled away and apprehended on chase. Some logs were recovered from the petitioners. It is submitted on behalf of the petitioners that they are innocent and they have no antecedent and on such false implication they are languishing in custody since 14.05.2017. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let both the petitioners, as indicated
Patna High Court Cr.Misc.
