The petitioner, already in custody, seeks bail in connection with S.T. No. 77 of 2016 arising out of Kanti P.S.Case No. 05 of 2016 registered under Sections 399, 402, 412 and 414 of the Indian penal Code, Section 25 (1-b)a/26(ii)/35 of the Arms Act and Section 20 and 22 of the N.D.P.S.Act.
Allegation in brief is that police raided the place where the accused persons had assembled including the petitioner and from the possession of the petitioner, one country made pistol and 04 live cartridges were recovered from his possession and one injection of Ketamine Hydrochloride-50 and two strips of Activan tablet.
Learned counsel for the petitioner submits that earlier
Patna High Court Cr.Misc. No.38213 of 2017 (2) dt.16-08-2017 2/2 the petitioner had moved for bail before this Hon'ble Court but the same was rejected with an observation that the petitioner may renew his prayer for bail after framing of charge. Now the charge has been framed in this case and he has been in custody since 04.01.2016.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Golu Thakur @ Shubham Raj, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Muzaffarpur in connection with S.T. No. 77 of 2016 arising out of Kannti P.S. Case No. 05 of 2016 with condition that (i) one of the bailors must be his own family member and (ii) he shall be present physically on each and every date before the trial court, in case of absence of two consecutive dates, his bail bond shall liable to be cancelled.
