JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kasba P.S. Case No. 134 of 2017 for the offenses under Sections 394, 411 and 413 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner was not named in the FIR. His name surfaced in the confessional statement of co-accused Bablu Jamadar and Afroz Alam. Afroz Alam has been granted bail by a Co-ordinate Bench of this Court vide order dated 1.2.2018 in Cr. Misc. No. 5554 of 2017. Although the petitioner was not named in the FIR but he has not been put on TIP. The petitioner is in custody since 25.3.2019.
