JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-07-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present petition has been filed for correcting certain typographical error, which has crept in the Order dated 16.09.2020 passed in Cr. Misc. No. 3891 of 2020. The Ld. counsel for the petitioner has submitted that the name of the father of the petitioner has inadvertently been mentioned in the aforesaid Order dated 16.09.2020 as Master Samil instead of Master Salim and in paragraph no. 3 of the said order dated 16.09.2020, section 302 of the Indian Penal Code has been mentioned instead of Section 304 I.P.C.

The learned A.P.P. for the State, Shri Choubey Jawahar, does not oppose the present petition. Accordingly, it is directed that the name of the father of the petitioner be read as Master Salim and the provision of the Indian penal code, under which the petitioner has been made an accused, be read as Section 304 instead of Section 302, in the aforesaid order dated 16.09.2020 passed in Cr. Misc. No. 3891 of 2020.

The petition stands disposed of with the aforesaid modification in the order dated 16.09.2020 passed in Cr. Misc. No. 3891 of 2020.
