The petitioner seeks bail in a case registered under Section 366(A)/34 of the Indian Penal Code.

Co-accused Sudhir Choupal and Manoj Choupal are said to have kidnapped the minor daughter of the informant along with two unknown miscreants and the petitioner and her mother Lali Devi are said to have facilitated the aforesaid kidnapping.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. Victim in her statement recorded under Section 164 Cr.P.C. has

No.54665 of 2018(3) dt.08-10-2018 2/2 candidly stated that the petitioner gave her chase in the orchard, but he regressed to his house and it is Sudhir Choupal who took her to Darbhanga Railway Station on motorcycle and left her on the said station. Thereafter she was taken to Saharsa and from there to Bhagalpur and then to Delhi by a lady and from there she was taken by her parents. Victim has also not named the petitioner in her kidnapping rather Sudhir Choupal. Petitioner has been languishing in custody since 09.01.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Darbhanga in connection with Sessions Trial No. 184 of 2018 arising out of Sadar (Bhalpatti O.P.) P.S. Case No. 382 of 2017.
