Petitioner seeks bail in Kursela P.S. Case No.10 of 2018 instituted for the offence under Section(s) 302 and 506/34 Indian Penal Code.

Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner in the written report.

The informant has alleged in the written report that the petitioner and other accused persons made indiscriminate firing on the husband of the informant on account of which he died.

Case diary has been received.

No.53074 of 2018 (3) dt.27-09-2018 2/2 Further statement of informant has been recorded in para 13 of the case diary, wherein, she has stated specifically that Vijay Mahto made indiscriminate firing on her husband on account of which he died. Similar statement has been made by other witnesses in paragraph Nos. 4 and 5 of the case diary. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Kursela P.S. Case No.10 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
