29-01-2015 Heard learned counsel for the petitioners, learned AC to AAG-14 and Sri Bipin Kumar, learned counsel for Magadh University, Bodh Gaya.

Both petitioners claiming to be son of deceased employee, who died in harness on 30.08.2002 as Class-IV employee, have approached this Court invoking its writ jurisdiction under Article 226 of the Constitution of India with a prayer to direct the Respondents to pay all death-cum- retiral dues to the petitioners in respect of Late Ram Subhag Singh ( father of

Patna High Court CWJC No.3571 of 2014 (2) dt.29-01-2015 2/2 the petitioners).

From the writ petition, it is evident that without demanding any justice from the concerned authority, directly petitioners have approached this Court.

Learned counsel for the petitioners submits even the Principal of the College has also made certain correspondence in the year 2013 in respect of claim of the petitioners. The Court is of the opinion that the writ petition can be disposed of granting liberty to the petitioners to file a detailed representation before Respondent no.4/ Registrar of Magadh University within a period of eight weeks from today. If such representation is filed giving all details of their claim, the Respondent no.4 is required to examine the same and if Respondent no.4 considers the claim of the petitioners as genuine, he is required to pass appropriate order for redressing the grievance of the petitioners within a period of three months thereafter. Even in case of refusal, the Respondent no.4 is required to pass a speaking order and communicate the same to the petitioners.

With above observation and direction, the writ petition stands disposed of.
