On trivial issue, minor sons of informant as well as petitioner quarreled and in the aforesaid background, it has been alleged that petitioner while was assaulting Shyambabu, wife of informant had gone to protest and during course thereof, she was also assaulted. When informant intervened, it has been alleged that Ram Pravesh Sah, Pappu Kumar, Mukesh Kumar, Nanhak Kumar have assaulted the informant. His another son Lalit was also assaulted with Lathi over his head and other parts of body. From the order impugned, it is evident that corresponding
Patna High Court Cr.Misc. No.34391 of 2017 (2) dt.18-08-2017 injuries have been found simple in nature.
Accordingly, petitioners, Ram Pravesh Sah, Pappu Kumar and Mukesh Kumar are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of ACJM-5, East Champaran at Motihari in Pakaridayal PS Case No. 58/2017.
