The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/411of the Indian Penal Code, 4(1), 21(1) of Bihar Mines & Mineral (Development & Regulation Act), 40(1) of Bihar Minor Mineral Concession Rules and 33, 41 & 42 of the Indian Forest Act.

The prosecution case is that during patrolling the informant being S.I. of Police seized tractor and trucks loaded with stones and boulders. The petitioner was found to be owner of the truck.

Patna High Court Cr.Misc. No.44983 of 2015 (03) dt.02-11-2015 2/2 It is submitted by learned counsel for the petitioner that admittedly the petitioner was not present at the place of seizure and petitioner is simply the owner of the public carrier.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dehri, District - Rohtas in connection with Dehri Town P.S. Case No. 300 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
