This is an application for bail in connection with Dalsingsarai P.S. Case No. 187 (5133005170187) of 2017 registered for the offences punishable under Sections 323, 452, 341, 307, 354B, 379, 34 and 427 of the Indian Penal Code. Allegation against the petitioner and other co-accused persons is of assaulting the informant and specific allegation is that petitioner had given rod blow on his head causing injury to him.

Submission of learned counsel for the petitioner is that altercation took place between the parties in which some persons have received injuries and assault is not intentional and further petitioner is in custody for three and a half months and charge sheet has been submitted in this case.

Heard learned APP also, who could not controvert the above submission.

No.41067 of 2017 (5) dt.16-10-2017 2/2 Having heard both sides and on perusal of the record it appears that injury is found to be simple in nature, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsingsarai, in connection with Dalsingsarai P.S. Case No. 187 (5133005170187) of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in disposal of trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be cancelled.
