Petitioner seeks regular bail in connection with Kajra P.S. No. 69 of 2020 registered for the offences punishable under Sections 25(1-B)a and 26 of the Arms Act.
The allegation as per the First Information Report is that the Police recovered one loaded country made pistol from possession of the petitioner and another country made pistol was recovered from the roof of the house of the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case at the behest of his brother with whom the petitioner has land dispute. Learned counsel next submits that the petitioner is in custody since 19.6.2020. Having regard to the submissions made by the parties and taking into consideration the materials on record, the nature of allegation and the petitioner is in custody since 19.6.2020 as well as the charge sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lakhisarai, in connection with Kajra P.S. No. 69 of 2020. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
