JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 02-07-2019 The petitioner has challenged the order dated 13.10.2018 passed by the District Programme Officer (ICDS), Bhojpur, Ara, whereby the selection of the petitioner on the post of Aanganbari Sevika has been cancelled.

2. The petitioner has already preferred an appeal against the aforesaid order before the District Magistrate, Ara vide Aanganbari Appeal No. 217 of 2018, which is still

Patna High Court CWJC No.13091 of 2019 dt.02-07-2019 2/2 pending consideration. An alternative prayer has been made in the writ petition for a direction to the District Magistrate, Ara to dispose off the aforesaid appeal at the earliest.

3. Without going into the merits of the case, this Court deems it appropriate to direct the District Magistrate, Ara to dispose off aforesaid Aanganbari Appeal No. 217 of 2018 preferred by the petitioner as early as possible, preferably within a period of three months from the date of receipt/production of a copy of this order.

4. Needless to state that any order passed by the Appellate Authority, viz., the District Magistrate, Ara shall only be after giving proper opportunity of hearing to the parties, viz., the petitioner, the private respondent, if any, and other stake holders.

5. With the aforesaid observation/direction, the writ petition stands disposed off.
