ANJANA MISHRA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Barauni (Chakiya O.P.) P.S. Case No. 433 of 2015 registered for the offences punishable under Sections 147, 148, 149, 186, 341, 342, 323, 332, 333, 353, 307, 379 and 427 of the Indian Penal Code and Section 3 of Prevention of Damaged to Public Property Act.

Learned counsel for the petitioners submits that there is a general and omnibus allegation against the petitioners and that there is no material to show that any of the present petitioners

Patna High Court Cr.Misc. No.34226 of 2016 (3) dt.28-10-2016 2/2 having given any specific blow to the informant. Case diary was called for, which has since been received.

Learned counsel for the State after perusal of the case diary submits that no specific allegation has been made against the present petitioners. The charge against all the accused persons is similar and they are said to have participated for the occurrence.

Considering the nature of allegations made and that for the same occurrence three separate cases have been filed and the petitioner are apprehending their arrest, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakiya O.P.) P.S. Case No. 433 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) ravi/- U T
