JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-04-2021 Heard Mr. Gopal Kumar Jha, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Araria (R.S.) P.S. Case No. 788 of 2019, dated 11.09.2019, instituted for the offence under Section 392 of the Indian Penal Code.

The petitioner has not been named in the F.I.R., but his prosecution in this case is only on the basis of the statement made by another co-accused person.

Though no recovery has been made from the petitioner and considering the fact that he is a person of

Patna High Court CR. MISC. No.39126 of 2020(2) dt.29-04-2021 2/2 clean antecedents, this Court is inclined to grant him anticipatory bail.

The petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria in connection with Araria (R.S.) P.S. Case No. 788 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
