JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Basantpur P.S. Case No. 70 of 2017 registered under Section 302/34 of the Indian Penal Code.

As per the prosecution case, the son of the informant is said to have been eliminated by hanging from the ceiling of the shop by some unknown miscreants and preceding to his death conversation with him was made on his mobile phone. It is submitted by learned counsel for the petitioner that the mobile phone by which the conversation was made with deceased is not hailing to him. The deceased was having illicit relation with the daughter of Hari Kishor Manjhi and the petitioner's name has surfaced in the case in the confessional

Patna High Court Cr.Misc. No.39613 of 2017 (02) dt.21-08-2017 2/ 2 statement of the said Hari Kishore Manjhi. There is no eye witness of the occurrence. The said Hari Kishor Manjhi has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.28065 of 2017 vide order dated 27.07.2017. The petitioner has been languishing in custody since 03.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No.70 of 2017.
