Earlier prayer for bail of the petitioner was rejected by order dated 18.1.2017 passed in Cr.Misc.No.43040 of 2016 with an observation to renew his prayer for bail after a period of six months before the court below and court below was directed to expedite the trial and if both original and supplementary cases were at the same stage, trial court may take steps for amalgamation of both cases.

Submission of learned counsel for the petitioner is that trial has commenced and only one witness has been examined and nine witnesses are to be examined, as such, trial could not be amalgamated and he has remained in custody for six months and, as directed, after rejection of his prayer for bail by the court below he is renewing his prayer for bail before this Court and he will abide by any condition that may be imposed upon him by this Court, if bail is granted.

Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri P.K.Dixit, Sessions Judge-I, Begusarai, in connection with Sessions Trial No. 133 of 2017, arising out of Barauni (Chakiya) P.S. Case No. 151 of 2011, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
