Because of the fact that the State-respondents have already filed their counter affidavit, which indicates that the canal, in question, has not been adversely affected by the

Patna High Court CWJC No.15161 of 2015 (6) dt.21-09-2016 2/2 ongoing construction of the road inasmuch as concerned area has been left out while carrying on the project, which forms the subject-matter of this writ petition.
