====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Ram Krishna Nagar P.S. Case No. 13 of 2017 for the offences punishable under Section 420 of the Indian Penal Code and Section 66 of the I.T. Act.
The case of the prosecution, in brief, is that when the daughter of the informant had gone to the A.T.M. for withdrawing money, then one boy came from the back side and had tried to help in withdrawing the money and in that process he had changed the ATM card and subsequently, a sum of Rs. 34,900/- is said to have been withdrawn by the said boy.
The learned counsel for the petitioner submits that the petitioner is a student of B.Sc. Part-I. The petitioner was
Patna High Court Cr.Misc. No.37983 of 2017 (2) dt.10-08-2017 2/2 apprehended in another case i.e. Ram Krishna Nagar P.S. Case No. 187 of 2017 and thereafter he has been remanded in the present case. It is further submitted that at present he is ready to deposit Rs. 20,000/- (Rs. Twenty thousand) before the learned trial court.
Having regard to the facts and circumstances of the case, I direct that the petitioner, above named, be enlarged on regular bail upon depositing a sum of Rs. 20,000/- before the learned trial court and on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned court of Chief Judicial Magistrate, Patna in connection with Ram Krishna Nagar P.S. Case No. 13 of 2017. It is further directed that the aforesaid sum of Rs. 20,000/-, so deposited before the learned trial court, shall be subject to final outcome of the connected Ram Krishna Nagar P.S. Case No. 130 of 2017, in the trial.
The petition is accordingly disposed of.
