The petitioner seeks bail in anticipation of his arrest in connection with Nautan P.S. Case No. 170 of 2020, dated 31.05.2020, instituted for the offences under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016. In view of the implication of the petitioner in a case of similar nature in the past, I am not inclined to exercise my discretion for grant of anticipatory bail to him.

Patna High Court CR. MISC. No.38559 of 2020(2) dt.16-04-2021 2/2 The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below, after taking into account every aspect including the fact that nothing was recovered from the possession of the petitioner in the earlier case about which reference has been given in paragraph 3 of the bail application, shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
