====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioners seek regular bail in connection with Barachatti P.S. Case No. 315 of 2021 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that the petitioners along with other accused persons snatched the she goat of the informant while he was going along with his goat.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.51619 of 2021(2) dt.15-04-2022 2/2 petitioners have got no criminal antecedent and they have not committed any offence in the manner alleged. He further submits that from perusal of the First Information Report, it is evident that the petitioners were apprehended by the local villagers and were handed over to the Police. He next submits that due to village rivalry, the petitioners have been implicated in this case and they are in custody since 30.5.2021. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioners are in custody since 30.5.2021, charge sheet has already been submitted and there is no likelihood that the petitioners will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Barachatti P.S. Case No. 315 of 2021.
