29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Begusarai Muffasil P.S. Case No. 314 of 2021, registered for the offence under Section 399, 402 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act.

As per the F.I.R., on a secret information that some miscreant have assembled to commit crime near Bhairwar School, a raid was conducted and this petitioner alongwith other co-accused persons fled away and during course of investigation, it has come that the recovered loaded countrymade pistol with one live cartridge were thrown by this petitioner while he was fleeing away from the place of occurrence.

Only allegation, against the petitioner, is that at the time of fleeing away, he threw something and as such, he was arrested. Petitioner is in custody since 01.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 314 of 2021.
