Petitioner seeks bail in anticipation of his arrest in connection with Tekari P.S. Case No. 375 of 2017 registered for the offences punishable under Sections 30(a), (c) and (d) of Bihar Prohibition and Excise Act, 2016.

Allegation as per FIR is of manufacturing of liquor by the petitioner and other accused persons and there is recovery of country-made liquor and other articles.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has been made accused only on suspicion and he has no criminal antecedent and further co-accused person has been granted

Heard learned APP also.

In view of prima facie allegtation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
