JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Kuchaikot P.S. Case No. 170 of 2017, registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code.

The case of the prosecution is that a raid was conducted and two persons were apprehended along with motorcycle whereupon they disclosed their identity as accused Imran Alam and Mantu Singh. It was disclosed by Imran Alam that he along with Mantu Singh and Anshu Kumar Singh are involved in the business of selling and purchasing of stolen motorcycle. It was further disclosed that one motorcycle was sold to the petitioner herein and his son Pinti @ Prince for a

Patna High Court Cr.Misc. No.37643 of 2017 (2) dt.10-08-2017 2/2 sum of Rs. 5,000/-.

The learned counsel for the petitioner submits that the petitioner is 80 years old person, hence, he is not in a position to ride motorcycle, he has got clean antecedent and he is languishing in jail since 28.06.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VII, Gopalganj in connection with Kuchaikot P.S. Case No. 170 of 2017.
