The petitioner seeks bail in Bettiah Town P.S. Case No. 312 of 2019, instituted for the offence under Section(s) 414/34, 420, 467, 468 and 471 of the Indian Penal Code. Counsel for the petitioner submits that petitioner has no criminal antecedent. He has been arrested merely on suspicion.
It is alleged in the written report that informant along with other Police personnel during course of vehicle checking saw three persons on Motorcycle coming from eastern side. On seeing the Police Party, they tried to run away, but on chase they were apprehended. They disclosed their names as Pradeep
Patna High Court CR. MISC. No.40741 of 2019(2) dt.05-07-2019 2/2 Kumar (petitioner), Sone Lal Kumar and Laddu Shukla. They did not produce any paper of the Motorcycle on demand. The Motorcycle was registered in the name of Raj Kishore Singh. No case has been lodged with regard to stolen Motorcycle. Petitioner is in custody since 2.4.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Bettiah Town P.S. Case No. 312 of 2019,subject to the condition that both the bailors will be the close relatives of the petitioner.
