17-08-2016 Heard Smt. Poonam Singh, learned counsel for the petitioner and Sri Shantanu Kumar, learned Addl. Public Prosecutor.

In this case, a supplementary affidavit has been filed on behalf of petitioner, wherein, it has been indicated that in paragraph - 1 of the main petition i.e. present restoration petition, incorrectly prayer for restoring Cr. Misc. No. 25208 of 2010 was made, whereas, the present petition was filed with a prayer to restore Cr. Misc. No. 29731 of 2012, which was filed for restoring the main petition and dismissed on 24-04-2013 due to non-prosecution.

After hearing learned counsel for the parties and considering the ground set-forth in the petition, same is allowed.

Patna High Court Cr.Misc. No.31081 of 2016 (3) dt.17-08-2016 2/2 Let Cr. Misc. No. 29731 of 2012 be restored to its original file.
