1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Triveniganj P.S. Case No. 38 of 2021 registered under Sections 341, 323, 376(D), 506, 144, 149 and 504 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused has already been allowed bail by a Co-ordinate Bench of this Court vide order dated 28.07.2023 passed in Cr. Misc. No. 38926 of 2023.

4. Taking into consideration the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the

No.43066 of 2023(2) dt.04-08-2023 2/2 learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Supaul in connection with Triveniganj P.S. Case No. 38 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
