The petitioner apprehend his arrest in Kamtaul P.S. Case No.169 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The petitioner and other co-accused are said to have assaulted the informant by means of tangi causing injury on his head. The accused persons also snatched cash of Rs.60,000/- and a chain made of gold from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. The occurrence took place on 27.10.2019, but the

Patna High Court CR. MISC. No.53184 of 2021(5) dt.28-07-2022 2/2 FIR was lodged on 11.11.2019, after delay of 15 days. It is submitted that the injuries are simple in nature. It is further submitted that the petitioner has got one criminal antecedent in which he was acquitted by the learned court below. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that there is delay in lodging the FIR, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga in connection with Kamtaul P.S. Case No.169 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
